1. Scope & parties
These Terms of Sale govern all orders placed through the online shop operated under the Atelier Kirk brand. The version in force at the time of your order applies.

A consumer is any natural person who enters into this contract for purposes that are predominantly outside their trade, business, craft or profession.
2. Products & descriptions
Each piece is fine jewellery, quietly made — many items are finished by hand. Minor variations in finish, weight, gemstone tone and patina are inherent to handmade work and are not defects; they are part of the character of an individual piece.
We take care to depict our jewellery faithfully, but colours and proportions may differ slightly from their on-screen appearance depending on your display, lighting and settings. Such differences do not constitute a defect.
3. Prices
All prices are stated in euros (EUR) and are final prices including any statutory value added tax applicable within the European Union. Shipping costs, where they apply, are shown separately during checkout before you place your order.
For deliveries outside the European Union — including the United States — import duties, customs charges, taxes and handling fees may be levied by the destination country. These are not included in our prices, are payable by the customer and are the customer’s responsibility. Please consult your local customs authority if you are unsure.
4. Order process & conclusion of contract
The presentation of products in the online shop is a non-binding invitation to order, not a binding offer. You place items in your cart, enter your details and review your order; by clicking the order button you submit a binding offer to purchase the goods in your cart.
We confirm receipt of your order without undue delay by email. This confirmation of receipt does not yet constitute acceptance. The contract of sale is concluded only when we expressly declare our acceptance or when we dispatch the goods to you.
5. Payment
The payment methods offered during checkout are available to you. Unless otherwise agreed, payment is due immediately upon conclusion of the contract.
Payment is processed by an external payment service provider, whose terms apply in addition. Your card and payment details are handled by that provider; we do not store full payment-card numbers.
6. Shipping & delivery
We ship worldwide to the address you provide. Insured shipping is free on orders over €150. Estimated delivery times and any charges are shown during checkout.
Full details — carriers, transit times, insurance and customs handling — are set out in our Shipping Policy. For consumers, the risk of loss or damage passes only when the goods are handed over to you.
7. Right of withdrawal & cancellation
If you are a consumer in the European Union, you have a statutory right to withdraw from this contract within fourteen (14) days without giving any reason. The period runs from the day on which you, or a third party named by you who is not the carrier, take possession of the goods.
To exercise it, inform us (Kirk & Epstein Trading Limited, Flat 2304, 23/F, Ho King Commercial Centre, 2-16 Fa Yuen Street, Mong Kok, Hong Kong, email: service@atelierkirk.com) by a clear statement before the period expires. We will reimburse all payments received, including standard delivery costs, without undue delay and no later than fourteen days after we are informed of your decision, using the same means of payment you used.
Practical steps, return addresses and how we handle gift returns are described in our Returns Policy. Consumers outside the EU may enjoy comparable cancellation rights under their local law.
8. Warranty & material guarantee
We stand behind our materials: every piece carries a lifetime material guarantee against defects in the precious metals and stones we use under normal wear. This guarantee does not cover ordinary wear and tear, accidental damage, loss, or alterations carried out by third parties.
This guarantee is additional to, and does not limit, your mandatory statutory warranty rights as a consumer for defective goods, which remain fully available to you.
9. Limitation of liability
We are liable without limitation for damage arising from injury to life, body or health, for intent and gross negligence, and wherever liability cannot be limited or excluded by mandatory law.
For slight negligence we are liable only for breach of an essential contractual obligation, and then limited to the foreseeable damage typical of this type of contract. Nothing in these Terms excludes or limits liability that may not be excluded or limited under applicable consumer-protection law.
10. Intellectual property
All content of this shop — including designs, product photography, text, the Atelier Kirk name and logo — is protected by intellectual-property rights and belongs to us or our licensors. You may not reproduce, distribute or otherwise use it without our prior written consent.
11. Force majeure
We are not liable for delay or failure in performance caused by events beyond our reasonable control — including natural disasters, conflict, strikes, carrier disruption, or failures of third-party infrastructure. We will inform you promptly and resume performance as soon as reasonably possible.
12. Governing law & dispute resolution
These Terms and any contract concluded under them are governed by the laws of Hong Kong, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods.
This choice of law does not deprive you of the protection of mandatory consumer-protection provisions of your country of habitual residence — including, for EU consumers, the mandatory rules of their member state, and for US consumers, applicable federal and state law such as that of California. We aim to resolve any complaint amicably; please contact us first at service@atelierkirk.com.
13. Severability
Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.
